This website, furandfuelco.com (the "Site"), is operated by Fur & Fuel Co., a sole proprietorship based in New Jersey ("Fur & Fuel Co.," "we," "us," or "our"). We offer this Site, including all information, tools and services available from it, to you, the user, on the condition that you accept all terms, conditions, policies and notices stated here.
By visiting our Site or buying something from us, you agree to these Terms of Service ("Terms"), including the additional policies referenced here and available by link: our Refund & Return Policy, Shipping Policy and Privacy Policy. These Terms apply to all users of the Site, including browsers, customers and contributors of content.
Please read these Terms carefully before using the Site. If you do not agree to all of these Terms, you may not access the Site or use any services. Any new features or tools added to the store are also subject to these Terms. We may update, change or replace any part of these Terms by posting updates to this page. Your continued use of the Site after changes are posted means you accept those changes.
Our store is hosted on Shopify Inc. Shopify provides the online e-commerce platform that lets us sell our products to you.
Section 1 – Online Store Terms
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependents in your household to use this Site.
You may not use our products for any illegal or unauthorized purpose, and you may not, in using the Site, violate any laws in your jurisdiction (including copyright laws). You must not transmit any worms, viruses or code of a destructive nature. A breach or violation of any of these Terms will result in immediate termination of your access to our services.
Section 2 – General Conditions
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information) may be transferred unencrypted and may involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks and is processed by our payment providers, not stored by us.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Site, use of the Site, or access to the Site, without our express written permission.
Section 3 – Made-to-Order (Print-on-Demand) Products
Our products are printed on demand. Each item is produced only after you order it, by our third-party print and fulfillment partner (Printify and its network of print providers). This means:
- Your order goes into production shortly after you place it, so changes and cancellations are only possible for a short window (see our Refund & Return Policy).
- Because each item is made for you, we do not accept returns or exchanges for wrong size, wrong color or change of mind. Please check our Size Guide before ordering.
- Misprinted, damaged or defective items are covered as described in our Refund & Return Policy.
Section 4 – Accuracy of Information; Product Images
We are not responsible if information on this Site is inaccurate, incomplete or out of date. Material on the Site is provided for general information only.
Product images are digital mockups. Actual colors may vary slightly because of monitor settings and the printing process. Print placement may vary slightly from item to item (our print partner allows a tolerance of about 0.5 inch), and garment measurements may vary slightly from the size chart (about 1 to 1.5 inches, depending on the product). These normal variations are not considered defects.
Section 5 – Modifications to the Service and Prices
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product or the Site (or any part of it) at any time without notice. We are not liable to you or any third party for any modification, price change, suspension or discontinuance.
Section 6 – Products
Some products may be available exclusively online through the Site and may have limited quantities or seasonal availability. We have made every effort to display product colors and images accurately, but we cannot guarantee that your device's display will be accurate.
We reserve the right to limit sales of our products to any person, geographic region or jurisdiction, and to limit quantities. All product descriptions and pricing are subject to change at any time without notice. We do not warrant that the quality of any products will meet your expectations, or that errors on the Site will be corrected.
Pet products (bandanas and pet hoodies) are novelty apparel. Always supervise your pet while it wears them, remove them if your pet chews them, seems uncomfortable or overheats, and never leave a pet unattended in apparel. Do not use a bandana or hoodie as a substitute for a collar, leash or harness.
Section 7 – Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. If we change or cancel an order, we will try to notify you using the email and/or billing address provided at checkout.
You agree to provide current, complete and accurate purchase and account information, including your shipping address, for all purchases. We are not responsible for orders delivered to an incorrect or incomplete address that you provided. Please see our Shipping Policy.
Section 8 – Optional Tools
We may provide you with access to third-party tools that we neither monitor nor control. You acknowledge that we provide such tools "as is" and "as available," without any warranties or conditions, and without any endorsement. Any use of optional tools offered through the Site is entirely at your own risk.
Section 9 – Third-Party Links
Certain content and products available through our Site may include materials from third parties. We are not responsible for examining or evaluating the content or accuracy of third-party websites, and we do not warrant and will not have any liability for any third-party materials, websites, products or services.
Section 10 – User Comments, Feedback, Reviews and Photos
If you send us reviews, photos of you and your dog in our gear, creative ideas, suggestions or other materials ("Submissions"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute and otherwise use them in any medium, including on our Site and social media. We are under no obligation to keep Submissions confidential, to pay compensation for them, or to respond to them. We will always ask your permission before featuring a photo of you or your dog on our Site or social media.
You agree that your Submissions will not violate any right of any third party, including copyright, trademark, privacy or personality rights, and will not contain unlawful, abusive or obscene material.
Section 11 – Intellectual Property
All designs, artwork, text, graphics, logos (including our chihuahua mascot) and other content on the Site are owned by Fur & Fuel Co. or its licensors and are protected by copyright, trademark and other laws. You may not reproduce, sell or create derivative works from our designs without our written permission. Buying a product gives you ownership of that physical item, not of the design.
Section 12 – Personal Information
Your submission of personal information through the store is governed by our Privacy Policy.
Section 13 – Errors, Inaccuracies and Omissions
Occasionally there may be information on our Site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
Section 14 – Prohibited Uses
In addition to other prohibitions in these Terms, you may not use the Site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any laws or regulations; (d) to infringe our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; or (j) to interfere with or circumvent the security features of the Site. We may terminate your use of the Site for violating any of these prohibited uses.
Section 15 – Disclaimer of Warranties; Limitation of Liability
We do not guarantee that your use of our service will be uninterrupted, timely, secure or error-free. Except as expressly stated in our Refund & Return Policy, the service and all products delivered to you are provided "as is" and "as available," without any representation, warranty or condition of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, in no case shall Fur & Fuel Co., or our owners, affiliates, contractors, suppliers or service providers, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind arising from your use of the Site or any product purchased through it. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some states do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
Section 16 – Indemnification
You agree to indemnify, defend and hold harmless Fur & Fuel Co. and its owners, affiliates, partners, contractors and service providers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
Section 17 – Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed from these Terms without affecting the validity of the remaining provisions.
Section 18 – Termination
These Terms are effective unless and until terminated by you or us. You may terminate them at any time by ceasing to use our Site. If we believe you have failed to comply with any term, we may terminate this agreement at any time without notice, and you remain liable for all amounts due up to the date of termination.
Section 19 – Entire Agreement
These Terms and any policies or operating rules posted by us on this Site constitute the entire agreement between you and us and govern your use of the Site, superseding any prior agreements. Any ambiguities in interpretation will not be construed against the drafting party.
Section 20 – Governing Law and Venue
These Terms, and any separate agreements under which we provide you services, are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or your purchase will be brought exclusively in the state or federal courts located in Bergen County, New Jersey, and you consent to the jurisdiction of those courts. Nothing in this section limits any rights you have under the consumer protection laws of your state of residence.
